Uninsured/Underinsured Motorist Insurance Claims

Approximately 23 percent of Florida drivers are uninsured, the fifth highest percentage of uninsured drivers in the nation. Nearly one in four Florida drivers may be driving without insurance, according to a recent study, and that number could rise by as much as five percentage points next year as the economic downturn causes unemployment rates to increase.

Uninsured motorist coverage (UM) applies when an at-fault driver has no liability insurance or inadequate coverage. It pays for injuries to you, your family members, or any other person in your car that were hurt by an uninsured or underinsured motorist. Florida law (627.727)

Florida law states that your insurance provider must offer you uninsured motorist coverage. He or she must present you with a document, authorized by the Florida Department of Insurance, to sign if you choose to reject uninsured motorist coverage.

How Much UM/UIM Coverage Should I Purchase?

You must purchase bodily-injury liability (BI) coverage in order to purchase uninsured/underinsured motorist coverage. The amount of UM/UIM you are able to purchase depends entirely on the amount of BI coverage you have - if you purchase $30,000 in BI coverage, you may only purchase up to $30,000 in UIM/UM coverage.

Uninsured motorist and underinsured motorist insurance pays for your damages if the driver - and/or owner - of a car that caused your accident does not have enough bodily injury liability insurance coverage to pay for your damages. UM coverage also protects you and your family members when they are traveling in other vehicles, even if it is not your car.

Motorcyclists should also purchase a UM policy. When in a motorcycle accident, UM coverage is often the only thing that can cover for injuries, pain and suffering
